Terms of Service

This document defines the contractual obligations and operational standards for all logistical engagements with JCW Trucking and Hauling LLC. By utilizing our transportation and hauling services, you acknowledge and agree to the following protocols, ensuring a secure, reliable, and legally sound partnership.

1. Definitions

"Carrier" refers to JCW Trucking and Hauling LLC. "Shipper" refers to the individual or entity requesting transport services. "Services" includes the pick-up, transportation, and delivery of cargo as specified in the Bill of Lading.

2. Quotes and Rates

All price quotations are valid for a period of 15 business days unless otherwise specified in writing. Rates are generated based on the weight, dimensions, and nature of the shipment provided by the Shipper. Final billing may fluctuate if actual load characteristics differ from original declarations.

3. Payment Terms

Standard payment terms are Net 30 days from the date of invoice. JCW Trucking and Hauling LLC reserves the right to assess a late fee of 1.5% per month on all overdue balances. For high-priority pharmaceutical or medical shipments, specific credit arrangements may be required prior to dispatch.

4. Shipper Obligations

The Shipper is responsible for ensuring all cargo is properly packaged, labeled, and prepared for transport, particularly sensitive medical devices or temperature-controlled pharmaceuticals. Accurate documentation, including Material Safety Data Sheets (MSDS) where applicable, must be provided prior to pick-up.

5. Carrier Liability

JCW Trucking and Hauling LLC maintains industry-standard insurance coverage. Liability for loss, damage, or destruction to cargo is limited to $2.00 per pound of the affected goods, unless a higher declared value is submitted in writing at the time of booking and additional insurance premiums are paid by the Shipper.

Notice: Carrier is not liable for cargo damage resulting from improper packaging by the Shipper or delays caused by Acts of God, public authorities, or strikes.

6. Claims

Claims for loss or damage must be filed in writing within 9 months of the delivery date, or in the case of non-delivery, within 9 months after a reasonable time for delivery has elapsed. Proof of delivery (POD) notes regarding visual damage must be recorded at the time of acceptance.

7. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of the State of New York. Any legal actions or proceedings arising from these terms shall be instituted in the courts of New York.
